Terms of Service — v1.0 — 17 May 2026
These Terms of Service (“Terms”) govern your access to and use of the Elepha website and the Elepha browser extension (together, the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Provider
The Service is operated by Daniel Arroyo (“we”, “us”, “our”), based in Spain.

2. Definitions
- “Service” means the Elepha website and the Elepha browser extension and any related features we provide.
- “You” or “User” means any person who accesses or uses the Service.
- “Content” means any text, data, profiles, memories, prompts, AI context, feedback or other material made available through, created in or stored with the Service.
3. The Service
The Service is provided free of charge. We may add, change or remove features at any time without prior notice. The browser extension runs locally in your browser and does not transmit your profiles, memories, prompts or AI context to us.
We do not currently offer paid plans, user accounts or any service that requires registration. If we introduce such features in the future, they will be governed by updated Terms that we will publish in advance.
4. Eligibility
You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this requirement.
5. Acceptable Use
You agree not to:
- use the Service in any way that violates applicable law or these Terms;
- attempt to probe, scan or test the vulnerability of the Service, or to breach any security or authentication measure;
- use any automated means (bots, scrapers, crawlers) to access, copy or index the Service beyond what is allowed by the robots.txt file;
- reverse engineer, decompile or disassemble the browser extension, except where such restriction is prohibited by applicable law;
- reproduce, redistribute, sell, sublicense or create derivative works from the Service or its Content without our prior written permission;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- use the Service to transmit unlawful, defamatory, harassing or otherwise harmful content.
6. Intellectual Property
All rights, title and interest in and to the Service itself, including the source code, design, trademarks, logos and Elepha-provided Content, are owned by us or our licensors. This does not include your Content or third-party content. Nothing in these Terms grants you any right to use our trademarks or brand assets without our prior written consent.
You retain ownership of the profiles, memories, prompts, AI context and other Content you create or store in the browser extension. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal use or internal business use, subject to these Terms.
7. User Feedback
If you send us suggestions, bug reports, ideas or any other feedback about the Service, you grant us a non-exclusive, royalty-free, worldwide and perpetual licence to use, modify and incorporate such feedback into the Service without any obligation or compensation to you.
8. Third-party Services
The Service may contain links to third-party websites or rely on third-party platforms, including the Chrome Web Store for distribution of the browser extension and AI chats where you choose to insert or paste content from Elepha. We are not responsible for the availability, content or practices of such third parties, and your use of them is governed by their own terms and policies.
9. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, secure or free from harmful components. You use the Service at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits our liability for fraud, gross negligence, wilful misconduct, or any liability that cannot be excluded or limited under applicable law, including the mandatory rights granted to consumers under EU law.
11. Termination
We may suspend or terminate your access to the Service at any time and without notice if we reasonably believe you are in breach of these Terms or if we discontinue the Service. You may stop using the Service at any time.
12. Changes to the Terms
We may update these Terms from time to time. The latest version is always available on this page. Material changes will be reflected in the version number and date shown at the top of this document. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Spain.
If you are a consumer resident in the European Union, this clause does not deprive you of the protection of the mandatory provisions of the law of your country of residence, including the right to bring proceedings before the courts of that country.
14. Miscellaneous
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
